Terms of Service

Blue Canoe Ltda (“us”, “we”, or “our”) operates the https://pinery.app website and the Pinery macOS app, including Prose (together, the “Service”).

Thank you for choosing Pinery! Your support is crucial in sustaining the development of this project. Pinery is independently developed without any venture capital or corporate backing. As an indie developer, my goal is to provide the best possible experience for users like you.

Please read these Terms of Service carefully. This agreement constitutes a legal contract between you and Pinery. Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

Subscription

You may subscribe for premium version of the app via Apple In App Purchase. You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set either on a monthly or annual basis, depending on the type of subscription plan you select when purchasing a Subscription.

At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it. You may cancel the subscription via your App Store app.

When your Paid Subscription ends, you will lose access to any app functionality that requires a Paid Subscription, including Prose where a subscription or eligible budget is required.

Fee Changes

We reserve the right to modify the fees for the Subscriptions. If there are any changes to the Subscription fees, they will take effect at the end of the current Billing Cycle. We will provide you with a reasonable prior notice of any change in Subscription fees, giving you the opportunity to cancel your Subscription before the new fees come into effect.

By continuing to use the Service after the Subscription fee change takes effect, you agree to pay the modified Subscription fee amount.

Refunds

Except when required by law, paid Subscription fees are non-refundable. If you wish to request a refund, we recommend contacting the Apple Support Team directly. You can find more information on the refund process here.

Prose and AI features

Prose is an optional AI writing companion in the Pinery app. Using Prose requires network access and an eligible subscription or budget.

When you use Prose, content you submit (including prompts and relevant manuscript context) is processed by Pinery and by third-party AI providers, as described in our Privacy Policy.

You own your manuscript. Suggestions from Prose are drafts for you to review. Nothing is written into your book unless you accept a proposed change. You are responsible for reviewing outputs and for any disclosures required by publishers or stores (for example AI-assisted content rules on Amazon KDP).

Prose outputs may be inaccurate, incomplete, or unsuitable for publication. You are responsible for fact-checking and for ensuring your use of the Service and any published work complies with applicable law and third-party rights.

Acceptable use

You agree not to:

• Use Prose or the Service for illegal content or activity
• Attempt to bypass budgets, rate limits, subscription checks, or other access controls
• Scrape, abuse, or overload our API or infrastructure
• Interfere with other users’ use of the Service

We may suspend or limit access if we reasonably believe these Terms have been violated.

Warranty

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Pinery does not warrant that a) the Service will function uninterrupted, secure, or available at any particular time or location; b) any errors or defects will be corrected; c) the results of using the Service, including Prose or other AI features, will meet your requirements or be accurate, reliable, or fit for any particular purpose.

Terms of Service Changes

At our sole discretion, we reserve the right to modify or replace these Terms at any time. We will notify you of any changes by posting the new Terms of Service on this page. These changes will take effect immediately after they are posted.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
